can't one argue that as the bore of a LBR is rifled, it is, de facto, a rifle... ?

I think this was pretty much the argument put by Mike Wells' defence team.

There are about half a dozen points that can be made to support the opposite point of view. Either they weren't made in the Wells case, or the jury were not persuaded of their validity. I wasn't there, and as far as I know, nobody has paid for a transcript, so only the summary of the judgment is available to study.

Interesting. In my mind, which admittedly is probably skewed right now, I'd consider the LBR a carbine, that just happens to have a revolver action. Because I'm not allowed a' real' pistol. But... I do see what you're saying. The language of the law isn't particularly clear, is it. No great surprise there though.

Think I'll file this under 'requires more research' for now.

My LBR slot on my certificate states "REVOLVER - Long Barrel".

For all my other slots, it states "RIFLE". If yours is the same, we're accepting it's not a rifle by allowing it to be entered as such on our FAC's.

AFAIK, you won't see the restrictions for LBR's (or Section 1 shotguns) on your certificate. The commonly held belief is that neither can be held on a club certificate. It may seem silly, but I'm not risking my licence over it.

The issue with club certificates and LBRs etc is that if the club can't lend them, the club doesn't have good reason to possess. If R v Wells stands up, that's not true.

Why differentiate in the first place? If it complies with rules regarding barrel length and overall length (30cm and 60cm OAL) why aren't they just classified as a S1 firearm and treated as such?

I might be getting confused here, but are we saying that Clubs aren't allowed LBR on there ticket?

If so how did my club get two on theirs with Police and HMO approval?

As I understand it (and a stretch of imagination helps!) LBR`s and LBP`s arrived on the scene after the last Firearms Act "overhaul".
They are in a grey, undefined area.
However if a club has got them on their club`s fac, I too would be interested in more info.
