Seems in the OP that they've done exactly that. Assumed the privileges of ownership of the item with no basis or right in law and nor does the owner agree that they may in the circumstances. Appropriation complete....

As saddler says, nowt to do with ITAR, end of story. ITAR is used as a cop out way too often.

If it's in the UK and it ISN'T prohibited thn IMO there's no reason for it to be confiscated - but read the small print.

Now then, what would that position be if they were in possession of a part that HAD to be in ticket, where's their legal authority on that, anyone? Have they got some sort of "exemption" to possess firearms etc that are "confiscated"! Come to think of it, what authority do they have to confiscate otherpeoples property..is not not theft? Like if you kep a ball that was kicked into your garden?

I'd get writing to them every day demanding it be returned and keep copies of all correspondence, if you're in England then a Small Claim at the County Court seems the way forward if the police aren't interested.

You'd sue for recovery of possession or cash value of the item - plus your osts...

Without reading the small print of the contract you enter with Royal mail, its not really possible to say whether they have acted dishonestly.

Maybe, but under what authority exactly? That could also be tantamount to an unfair contract term...maybe a wee word with Trading Standrds or whatever they are called nowadays.

Probably something similar to storage units where rent is not paid and they dispose / sell off the contents.

If its in a contract and the owner has ( even unwittingly ) entered into that contract, it becomes a civil dispute.

I would be surprised if there is not a contractual ( or even legislation ) eventuality for covering seized items.

And if you claim "unfair contract" then its definately civil dispute rather than theft.

Update...

As I sold the item and the buyer paid me in full, & the buyer has since been fully repaid by e-bay/paypal neither of us hold any ownership of the item, therefore E-bay/GSP are now the owners, and they can do what they like to it even sell it on destroy it or whatever. So I will not be getting it back.

The package was stopped and given a restricted label by UK customs so E-bay have told me. So a Parker Hale Enfield No4 target sight Model 8/53 is dangerous well thats a new one on me.....

Spoke to a large E-bay retailer yesterday they stopped using the GSP system last year after they found out GSP open your package then repackage in their own packets/boxes, so then they know whats inside.....Not sure how true that is...
