Asking the shop to sell your gun; did you notify what your minimun selling price would be? Instructing the shop to sell your gun in their shop is different to instructing them to give the gun to a third party to sell it and I would consider it as a breech of the selling agreement unless you said something simular to "I don't care how she is sold, as long as I get more for her".

If it happened to me, I would ask (demand) which auction house sold the gun and complain to the trading standards. I think at this point if you are still polite with the shop then it is time to stop!

m7jnu, agreed. Back today to see what they got, if no more info then it's a polite but firm 10 days to pay me X amount then I'll think about a small claim.

I can sue for recovery of possession but since it's gone then I can ask for a sum of money equivalent.

As I said, it was NOT theirs to give to auction, i.e. a third party.

Chuck if this goes to dispute it will all hinge on what instructions you gave the gun shop. Unless something was put in writing it is going to be very difficult for you to prove what instructions you gave them and no doubt their version will differ from yours. So unless you have some evidence to support your claim I think that you will have to write this one off to experience.
I assume that you informed your local constabulary at the time of the disposal, what exactly did you tell them?

Very true, I would still push it as far as possible; it will make the shop think twice if it were to ever occur again. I might just be the case of calling a bluff.

I really hope you get a satisfactory outcome and the shop.

FLO was notified same day, all above board...Shop told to SELL IT. his excuse was he could not sell it so he sent to auction, as he would do with scrappers. It was not his decision to make and there was no attempt at contacting me.

We'll see in due course, only here for another 36 hours or so...it might need to ait till I come back - or I just hit him with a complaint and demand for the same gun, scope, mags and box to be delivered to my RFD mate.

chapius, in what way mate..?? THEY were told to sell it, get best price ..no instruction or authority to scrap or send it to auction.
