Any solicitors/ legal advisors?

Posting of negative comments in the Gunshop section could bring unwanted criticism on the forum, having said that it is important to let members know if dealings with a Gunshop were less than ideal for you. To that end we will allow what will be known as the 'Scotsgun Ruling'

The Scotsgun Ruling:

"As I've yet to have a 'positive' experience there, I'll refrain from commenting further."

Beyond that please take it up with the Gunshop, if you do resolve the issue in a agreeable manner let us know!

Good afternoon ladies and gents,

Another update on this tale of woe, my "man" attended his meeting with the Enforcement of Judgements Office (EJO) in northern Ireland. I have received their paperwork on the meeting at which no offer of payment was made and the debtor set out his financial position. Apparently now the EJO now look into the details of the meeting and decide on the next step, apparently this could take some time. Unlike England you cannot just send round the bailiffs and seize his possessions so there is little incentive for him to pay up until the EJO makes a decision. All very annoying and enough to put me off dealing with any individual or company from northern Ireland in the future.
No doubt the process will continue at a snails pace, I'll post updates as they occur.

All the best phil

A bit weird that NI differs in that respect to GB, NI belongs to GB?

Christel, you have no idea how different, I spent hours on the phone trying to pursue the case, both have very different systems and no one in England could explain how to proceed,( plenty of advice on what you cannot do but not much on what you can) not a single helpline or website that I could find provided any information, only with help from Irish courts did I get this far.

In summary,

I took out a county court action through my local court.
Once I had a judgement in my favour, it had to be registered with the northern Irish courts, (english county courts have no powers in northern ireland)
Then a transfer of money order had to be made, basically registering the debt in the Irish system.
When the judgement was not met by my "man" I applied to the EJO for enforcement to begin, which is where it is now.
It's no wonder that he thought I would not bother.

But most surprising to me was the response from the firearms dept. Within northern Irish police service, they had no interest whatsoever in the fact that one of their RFD's had sold an unproofed rifle. According to them I would have to raise this with the mainstream police service rather than the firearm dept.

That slap dash attitude doesn't surprise me at all.

Years back while on holiday in Southern Ireland my car was written off by a drunk driver. The police that attended offered to take myself, my then boyfriend and cousin back to our accommodation after he had a pint with another officer. He then drove like we were doing a rally stage through the forest. He also promised he would help me do all the paperwork I needed to do before I left, even told us where he lived if the station was closed. Never tracked him down again. Oh, by the way the drunk driver and his brother walked away with £22,000 between them :G

Can you not just have him sequestrated..he has had ample time to cook his books so to speak..being sequestrated would allow his affairs to be fully investigated rather than trumped up by some accountant.

The whole thing is a farce...Not quite sure why you could not get judgement in England as I assume you are based there...He is however doing what I would have any of my clients do...make you rack up a huge legal bill thenh go bust..and leave you MORE out of pocket at the end of the day..

Sincerely hope that is NOT the intention artiglo but be careful.

Good morning Chuck,

The judgement was granted in the UK and " his " attempt to have it set aside was dismissed by the same court. However English courts have no enforcement powers in northern Ireland and the judgement had to be transferred to the northern Irish system.
The whole sorry story is what you get when dealing with disreputable/dishonest individual. Fortunately I have managed to do everything myself and only had to pay court and enforcement fees, though must be said I could have bought plenty of reloading supplies with the cash instead.
I've been speaking to the enforcement people and there is a process that needs to be followed and it's very slow.
The only good thing to come out of it all is that hopefully this " gents " practises are now well known and he'll struggle to do it again.

Id say this is what he's at also. He's probably forgetting one very important
factor though in his wool pulling exercise, he might like to do business again
and by the time all of this is over his already gangster reputation will be even
more tarnished. Ive had my moments with this individual and despite being warned
by several others that had dealings with him I gave him a chance, big mistake but
big lesson learned too. Dont worry Phil, everything comes to he who waits, I would'nt
let cleverness get in the way, I wouldnt care what it costed me either, Id keep
pushing till I got what I wanted. He'll be no stranger to potential customers when this
is resolved and by the looks of things he's on a very large advertising campaign too.
