Not sure where that comes from. I think most RFD's would hold a firearm, for a non-returnable deposit, until you have the variation.

I have been to Eley and batch tested ammo.
My RFD then placed my order with ELEY for 10,000 Tenex and 5,000 Edge.
I have paid my RFD in full.
This is far in excess of whats on my ticket.
The bulk is held by my RFD.
My FLO / FEO are well aware and don't care, as long as it is held by my RFD and he is within his ammo limit.

Its been discussed in depth on this very forum - i think in the distance sales sticky. Most RFD's may well do it - doesn't mean its double legal; though :-)

That is definitly true, I was mearly presenting an option that would (in theory) allow for the legal transfer of funds to the RFD amd in return potentially get bulk ammo prices.

Obviously the account contract could be made to have certain stipulations such as "the account holder may purchase x ammo at £y per hundred" or something similar like an account holder discount. But that comes down to business arrangements between the customer and the rfd.

Obviously this is entire debate is academic until someone actually does it, at which point in will be very interested in the outcome

Show me where, in the Firearms Law, that it says this is illegal and I will believe you. I just have not come across it.

Again another aspect that relies on interpretation. s1(1)(a) of the 1968 states;

"(1)Subject to any exemption under this Act, it is an offence for a person—
(a)to have in his possession, or to purchase or acquire, a firearm to which this section applies without holding a firearm certificate in force at the time, or otherwise than as authorised by such a certificate;"

And it hinges on "possession, purchase or acquire". There is ample legislation and case law which decrees that you do not have to be holding a said article to actually be in possession of it. Likewise, is a proprietary interest i.e. deposit paid, equal to the purchase or the acquisition of such? If any are, then you require a valid FAC with an appropriate variation to put a deposit down or have an RFD hold or store for you.

It may seem wafty, but that is the broad brush nature of primary legislation and in the absence of case law, you have to accept that given all other judgements on "possession" may come into play until a court defines. And if you're prepared to become the stated case of not...

I find it really interesting reading all the replies. Without case law there is no definitive answer . I put the same thread on another forum and to say it went badly would be an understatement. Thanks for all who have contributed respectfully.

This answer I got back was that as long as I dont have possession nor access above the limits set by the terms of my FAC, it is legal.

Yes, and it is not illegal to subsidise an RFD to purchase ammo that he agrees under a "Gentleman agreement" to set aside for who-ever helped him financially to secure that supply.
